CHIC DRESS RENTALS AGREEMENT

Introduction:

I. Purpose of the Agreement
This Dress Rental Agreement ("Agreement") outlines the terms and conditions under
which you, the customer ("Renter"), agree to rent a dress ("Dress", “Garment”) from
Chic Dress Rentals ("We","Us","Our"). By completing a rental booking, you
acknowledge and accept the terms set forth in this Agreement. The purpose of this
Agreement is to clearly define the responsibilities, rights, and obligations of both
parties to ensure a smooth rental experience.


II. Rental Business Overview
Chic Dress Rentals is a dress rental service operating in compliance with New
Zealand's Consumer Guarantees Act 1993 and Fair Trading Act 1986, providing
high-quality garments for special occasions. Our goal is to offer you access to
designer and high-end dresses without the cost of purchasing them outright. We are
committed to ensuring transparency in our rental process and customer satisfaction.
Our rental services are only available to New Zealand based Renters.


III. Rental Process
(A) Booking and Reservations
All rental bookings must be made through our website. Upon booking, you will
receive a confirmation email with the details of your rental, including the rental
period, dress selected, and the rental fee. Bookings are confirmed once
payment has been received, subject to the availability of the dress.
We offer postal and local pickup rentals. Postal orders cover most regions in
New Zealand. Pickup is limited to the Gisborne Region between our working
days Monday, Tuesday, Wednesday, Thursday, Friday not including Public
Holidays (“Working Day”). For this option select pickup at checkout.


(B) Availability of Dresses
Availability of dresses is subject to prior rental bookings and internal
availability checks. We make every effort to provide accurate availability on
our website; however, dresses may be unavailable due to maintenance,
damage, or other unforeseen circumstances. In such cases, we will inform
you promptly and offer alternative options or a full refund if a suitable
alternative cannot be found.

IV. Rental Duration
The rental duration is subject to the selected period by the renter. The renter may
choose a rental period for the dress at the time of booking. Our standard rental
periods are as follows:
(A) Standard rental: 1–2 days
(B) Long-term rental: 3–7 days
You may select the period that best suits your needs. For all local pickup rentals the
garment must be returned on the next working day.


V. Selecting a timeframe for Orders
On our booking Calendar, you have the option to choose either a Standard or long
term rental duration (this will also be subject to other booked periods).


(A) Booking day:
Please ensure that you book for the day that you are wearing the item (“Event
date”). If you are leaving a day before your event, please select that day. All
rentals must be booked within 3 working days of the time you create the
booking.

(1) Example 1: I have an event on Thursday 20 th , I wont be travelling and I
want a standard rental, I will select Thursday 20 th as the booking day but I
must have made this booking by Tuesday 12PM. I will Return this rental to
the post by Friday 4PM.


(2) Example 2: I have an event on Friday the 21 st , but the event is in Auckland
and I will be travelling on the Thursday and I want a standard rental. I will
select the day before Thursday 20 th so that my garment arrived on the day
I travel. I will return this rental to the post by Monday 4PM.


(B) Return day:
All standard Rentals on Monday, Tuesday, Wednesday, Thursday must be
returned the next working day.
All Standard Rentals on Friday, Saturday, Sunday Must be Returned by the
following Monday 4PM.


(1) Weekday Rental Example:                                                                                                                   My Event was on a Tuesday, I had a standard rental duration, so I must
return the item to the post by Wednesday 4PM.


(2) Weekend Rental Example:
My event was on Friday, I had a standard rental duration, I must return
the item by Monday 4PM.


(3) Pickup Rental Example:
I have an event on a Tuesday, I have a standard rental duration. I must
return the item the next working day by 4PM.

VI. Pricing and Payment


(a) Rental Fees and Breakdown
The rental fee for each dress is as specified on our website. Additional
charges may include delivery fees, late return fees, or cleaning fee. Prices are
subject to change, but any changes will be communicated to you in advance,
and existing bookings will not be affected by price increases.


(b) Payment Methods
Payments can be made via credit card, bank transfer, or other approved
methods. Full payment is required at the time of booking. Failure to make
payment may result in cancellation of your booking.
VII. Late Fees or Charges for Unreturned Items
If the dress is not returned on the agreed return date, the renter will incur a late
return fee of:
(a) $20 for the first late day
(b) $40 for the second late day
(c) $60 for the third late day
If the dress is not returned by the fourth day from the original rental period, we may
charge the full replacement cost of the dress, in addition to any late fees, as outlined
in this agreement. These charges are intended to ensure fairness to all customers
and cover the potential unavailability of the dress for future bookings.


VIII. Dress Care and Handling

(a) Customer Responsibilities for Care
The customer agrees to handle the dress with care and follow the dress care
instructions provided. The dress should be stored in a cool, dry place and
away from pets, smoking, or harsh chemicals. Any damage resulting from
negligence or improper handling will be the responsibility of the customer.
The customer agrees not to use the rented dress for any commercial or illegal
purposes. Smoking, eating, or wearing the dress in harsh or hazardous
environments (e.g., outdoor activities) is strictly prohibited.

(b) Cleaning Guidelines
The customer is not required to clean the dress before returning it. We will
handle all cleaning. However, if the dress is excessively stained or requires
special cleaning due to damage caused by the customer, a cleaning fee will
be charged.
(i) Should the damage to the garment become beyond repair, the
customer will be liable for the full RRP of the garment.
(ii) Cleaning fees for excessive stains may range from $20 to $100
depending on severity. Repair fees for minor damage will be assessed
on a case-by-case basis.


(c) Alterations and Modifications
(i) Alterations or modifications to the dress are strictly prohibited. Any
changes made to the dress without prior consent will result in a charge
for the full replacement cost of the dress

IX. Condition of Garment
The customer agrees to return the dress in the same condition it was rented, free
from stains, damages, or alterations. Any damage or excessive wear will result in an
additional charge for repair or replacement.
We do not guarantee a perfect fit. We encourage customers to consult our size guide
or contact us with sizing questions prior to booking. Refunds are not offered for
sizing issues unless a major discrepancy is proven.

The customer will be fully responsible for any damage, loss, or theft of the dress
during the rental period. If the dress is damaged, the customer will be charged for
repair costs. If the dress is lost or irreparably damaged, the customer will be charged
the full replacement value of the dress, plus any applicable shipping fees.

X. Shipping and Delivery
We utilise New Zealand Post courier services for our shipping of postal orders.
Rural orders incur additional cost for postage. Delivery times are typically 2 days
for postal orders, depending on the location. The customer will receive a tracking
number for their order once it is posted. You may wish to track your item on the

Customers are responsible for the cost of delivery and return shipping, which will
be calculated at checkout. Delivery times are typically 2 days for postal orders,
depending on the location. All shipping fees are non-refundable.
Postal returns must be lodged with NZ Post and scanned by 4 PM on the return
day. Proof of lodgement should be retained.


(A) Late Arrival
Should your garment not arrive on the anticipated date, and you have
followed the correct rental booking timeframe procedures, there was no
attempted delivery and the parcel is late at no fault of your own, you may
choose to receive a refund or store credit for your rental amount.


(B) Parcel Delays
Often New Zealand post in busier seasons incur delays, we make no promise
that your garment will arrive on your desired selected date. However, we will
ensure that every measure is taken so that it will arrive on your rental date.

XI. Cancellation
Should a customer wish to cancel their rental, they may do so up to 4 working
days before their intended rental date. A refund or store credit may be issued.
Any late cancellations will incur a partial refund in respect of a 20% cancellation
fee.


XII. Force Majeure Clause
We are not liable for any failure to deliver or delay in performance due to events
beyond our reasonable control, such as natural disasters, strikes, or government
regulations.

XIII. Privacy and Data Protection
We are committed to protecting your privacy. Any personal information you
provide will be used only for the purpose of processing your rental and will not be
shared with third parties without your consent, except as required by law. For

With your consent, we may use customer-submitted photos or reviews for
marketing purposes. You can withdraw consent at any time.


XIV. Dispute Resolution
Any disputes arising from this agreement will first be addressed through informal
negotiation. If a resolution cannot be reached, the matter will be referred to
mediation. If mediation is unsuccessful, the dispute may be taken to the relevant
New Zealand court.


XV. Governing Law and Jurisdiction
This agreement is governed by the laws of New Zealand. Any legal disputes will
be handled in the courts of New Zealand.


XVI. Liability Waiver
The company is not liable for any injuries or damages that occur while wearing
the rented dress. The customer agrees to use the dress responsibly and
acknowledges the company's limited liability in all circumstances.


XVII. Right to refuse Service
We reserve the right to refuse service to any individual at our sole discretion,
especially in cases of misuse, previous violations, or abusive conduct.


XVIII. Customer Acknowledgement
By renting a garment from Chic Dress Rentals, the customer at checkout must
select the mandatory terms and conditions checkbox which acknowledges that
they have read, understood, and agreed to the terms and conditions outlined in
this contract. The customer further agrees to return the dress by the specified
return date and in the condition, it was rented.
